These General Terms and Conditions (GTC) govern the use of the mobile applications of IQ WORLD GAMES AG. They are part of any usage and apply bindingly upon downloading, installing, or using the app, even without explicit consent by clicking or registering.
Please read these terms carefully before using the app. By using the app, you confirm that you have understood these GTC and agree to them.

These GTC govern the use of the mobile apps of IQ WORLD GAMES AG.
The apps are provided through platforms such as the Apple App Store or Google Play.
Payments and subscriptions are made through the respective platform provider. IQ WORLD GAMES AG is not a contractual partner of these payment agreements and assumes no contractual or legal obligations related to payments, refunds, subscriptions, or support requests processed via third-party platforms.
Updates occur to ensure functionality and security.
Access to camera and location is only granted with explicit consent.
In-app purchases and subscriptions can be made and automatically renewed unless canceled in time.
Withdrawal and refunds must be processed through the respective app store.
Liability exists only in cases of intent, gross negligence, or injury to life, body, or health.
Swiss law applies; the jurisdiction is Zug, Switzerland.
§ 1 Scope of Application
This app is aimed exclusively at adults (from 18 years). Use by minors is prohibited.
These General Terms and Conditions (“GTC”) apply to the use of the mobile applications (“apps”) of IQ WORLD GAMES AG and for all future versions, expansions, and similar mobile applications. They apply to consumers and entrepreneurs unless explicitly stated otherwise.
§ 2 App Store and Contractual Partners
The provision of the apps occurs through third-party platforms such as the Apple App Store or Google Play. The contractual partner for purchases and subscriptions is exclusively the respective platform provider. IQ accepts no liability for payment transactions, refunds, or technical disruptions on these platforms.
§ 3 Updates and Functionality
IQ provides security-relevant and legally required updates. Functions may change, expand or be discontinued at any time. Users have no claim to the retention of certain functions even if they have been previously advertised, provided, or used. Changes to functions are made at the discretion of IQ WORLD GAMES AG to safeguard technical, economic, or legal interests.
§ 4 Data Protection and Access Permissions
Access to the camera, location or other device functions occurs only with the explicit consent of the users in accordance with Swiss data protection law (DSG) and the EU General Data Protection Regulation (GDPR), where applicable. § 5 In-App Purchases and Subscriptions
Digital content and subscriptions can be purchased within the app. Subscriptions renew automatically, unless they are canceled in time. Billing is done via the respective app store. Price changes are reserved; users will be informed about this in due time.
§ 6 Right of Withdrawal and Refunds
Withdrawal and refunds are to be processed exclusively through the respective app store. IQ is not responsible for this. Statutory consumer rights remain unaffected.
§ 7 Liability
IQ WORLD GAMES AG provides the mobile application free of charge and "as seen". The app is intended solely for private entertainment and does not contain security-relevant, medical, or pedagogically certified content.
Liability of IQ WORLD GAMES AG – regardless of the legal grounds – is excluded, unless mandatory legal provisions are contrary. In particular, IQ accepts no liability for damages arising from the use or unavailability of the app, including indirect damages, data loss, lost profits, system failures, or compatibility issues.
This liability disclaimer does not apply in cases of intentional or grossly negligent behavior or in cases of injury to life, body, or health, provided these were caused by IQ WORLD GAMES AG.
Users are responsible for backing up their own data and device settings.
§ 8 Usage Rights
IQ grants users a simple, non-exclusive, non-transferable, and non-sublicensable right to use the app. Reverse engineering, editing, duplication, distribution, and any further use of the app or its components are prohibited unless explicitly permitted by mandatory law, especially for ensuring interoperability in accordance with Art. 5 of the EU Directive 2009/24/EC.
All content, graphics, software components, and databases of the app are protected by copyright. Any unauthorized reproduction, distribution, or publication – especially in the context of piracy, cracked versions, or in file-sharing networks – is prohibited and will be prosecuted under civil and criminal law.
IQ WORLD GAMES AG expressly reserves all rights to the app and its content, including any trademark, design, and patent rights.
§ 9 Jurisdiction and Applicable Law
The substantive law of Switzerland applies. The jurisdiction is Zug, Switzerland, provided the user is an entrepreneur or a legal person. The UN Sales Convention is excluded.
§ 10 Severability Clause
If individual provisions of these GTC are wholly or partially ineffective, the effectiveness of the remaining provisions remains unaffected. Instead of the ineffective clause, a regulation will apply that comes closest to the economic purpose.

Consumers residing in the European Union have the right to file complaints with the competent data protection supervisory authority. For Germany, this is the Federal Commissioner for Data Protection and Freedom of Information (BfDI), for other EU countries the respective national supervisory authority.
For out-of-court dispute resolution, the EU platform for online dispute resolution (ODR platform) can be used: https://ec.europa.eu/consumers/odr. IQ WORLD GAMES AG is currently not obligated and not willing to participate in a dispute resolution process before a consumer arbitration board.
§ 12 Code of Conduct, Age Rating and Prohibited Use
The use of the app for illegal, offensive, discriminatory, or violent purposes is prohibited. In case of violation, access may be permanently blocked; legal action remains reserved.
The use of the app is permitted exclusively for adults (from 18 years). Use by minors is prohibited and may result in permanent blocking and legal prosecution in case of violation. The provider reserves the right to request identity verification in case of doubts regarding the age declaration. Legal guardians or representatives are liable for all actions of minors who access the app in violation of these GTC. IQ WORLD GAMES AG excludes any liability for damages or obligations arising from unauthorized use by minors. For users from Germany, the Youth Protection Act (JuSchG) applies; content subject to age restrictions may only be used by correspondingly aged individuals.
§ 13 Export Control & Sanctions Law
The app may not be used, exported, or transferred in countries that are subject to sanctions, embargoes, or export restrictions. Users are required to comply with all applicable national and international export control, customs, and sanctions regulations, including EU regulations, US Export Administration Regulations (EAR), and comparable regulations.
